A three-judge panel Sunday night refused to order Orange County to put a sick-time initiative on the Nov. 6 ballot, saying the group behind the effort had sued the wrong person in Mayor Teresa Jacobs.

But the ruling allows the group to refile its legal claim Monday.

“Before the Court can reach the merits” of the request to put the measure on the ballot, “the proper party must be before the court,” said the panel headed by Circuit Judge Frederick Lauten in a rare Sunday night ruling. Orange County, not Jacobs, is the proper party, the judges said.
